DB directs Comm Secy H&UDD to file ATR against Ex-MD, DGM in Rs 27 cr scam

Division Bench of the State High Court comprising Chief Justice Bader Durrez Ahmed and Justice Sanjeev Kumar in a significant order in the open court directed Commissioner/ Secretary to Government of J&K, Housing and Urban Development Department (H&UDD) to file Action Taken Report (ATR) against Ram Paul Sharma, former Managing Director J&K, Housing Board and Aftab Rashid Pandit, the then DGM Housing Board Unit-II Srinagar with regard to the enquiry report submitted by Enquiry Officer M. Raju, former Commissioner Jammu Municipal Corporation and presently Commissioner/Secretary PHE J&K Government. The Division Bench also directed the Senior AAG S. S. Nanda appearing for H&UDD to file the ATR within two weeks from today.
These Court directions were passed in the much publicised Public Interest Litigation (PIL) titled ‘Sheikh Mohd Shafi and another versus Union of India and others’ wherein the petitioners have highlighted rampant corruption in State of J&K and non grant of prosecution sanction against high ups against whom the SVO has sought sanction in various scams.
After hearing Advocate Sheikh Shakeel Ahmed with Advocates Rahul Raina and Supriya Chouhan appearing for the PIL whereas Senior Additional Advocate General (AAG) S. S. Nanda for H&UDD, Senior AAG Nirmal Kotwal for PWD and Government Advocate Tarun Sharma for Finance Department, the Division Bench headed by Chief Justice Bader Durrez Ahmed directed Senior AAG Nirmal Kotwal appearing for Commissioner/Secretary PWD (R&B) to file the status report within two weeks regarding the progress of the departmental enquiry initiated against four Executive Engineers who were on deputation to J&K Housing Board namely Tarsem Lal, then DGM Housing Board, Jammu, Bashir Ahmed Bhat, then DGM Housing Board, Srinagar, G.H Khanday, then DGM Housing Board, Srinagar and Joginder Lal then DGM Housing Board, Jammu when works to the tune of Rs. 27 crore were executed.
Division Bench further directed Government Advocate Tarun Sharma to file the updated status of the departmental enquiry within two weeks with regard to then Financial Advisor J&K Housing Board Kulbushan Kumar who was on deputation to J&K Housing Board during the time of the execution of works.
When this PIL came up for hearing, Advocate Sheikh Shakeel Ahmed submitted that the Enquiry Officer M. Raju former Commissioner JMC who was appointed vide Govt. Order No. 142-HUDD of 2017 dated June 15, 2017 to conduct regular departmental enquiry against Ram Paul Sharma then MD J&K, Housing Board and Aftab Rashid Pandit, then DGM Housing Unit-II Srinagar has submitted his enquiry report to the Commissioner/Secretary H&UDD holding aforesaid officers responsible for grave financial irregularities and procedural deviations which lead to the depletion of financial reserves of the J&K Housing Board to the tune of Rs. 27 crore.
Advocate S. S. Ahmed further submitted that the enquiry report wherein Ex MD and then DGM were indicted by the Enquiry Officer is lying with Commissioner/Secretary H&UDD and no further action is being taken in the matter. At this stage, the DB put a specific query to Senior AAG S. S. Nanda as to what action has been taken by H&UDD in the matter and Senior AAG S. S. Nanda responded that the enquiry report is under examination by the Administrative Department.
