A bill was introduced in the Rajya Sabha on Monday to replace the order on the transfer and posting of senior officers of the Delhi government.
Home Minister Amit Shah introduced the Government of the National Capital Territory of Delhi (Amendment) Bill 2023 for discussion after the Upper House reconvened at 2 am after he was adjourned for the pre-lunch session.
The bill was passed in the Lok Sabha last week.
The central government issued the order on May 19, a week after the Supreme Court handed over control of Delhi services, except police, law enforcement, and land, to an elected government led by Chief Minister Arvind Kejriwal.
The Delhi government approached the Supreme Court to block the Delhi National Capital Territory (Amendment) Ordinance 2023, which was promulgated on May 19. However, the Supreme Court last month refused to grant an interim stay on the Centre's order to monitor services in Delhi. He sent the Government of the National Capital Territory of Delhi (Amendment) Ordinance, 2023 to the Constitution for scrutiny.
Congressman Abhishek Manu Singhvi opposed the bill in the debate, saying it was a "retroactive bill" that was "completely unconstitutional".
He also said it was a "first attack on the people of Delhi and an insult to federalism".
On the other hand, BJP's Sudhanshu Trivedi refuted the opposition's claims and defended the bill. He said the order and then the bill demanded to notice how the AAP government in Delhi had embarked on a "reckless wide-ranging bureaucratic drive" after the Supreme Court verdict.
The National Capital Public Service Authority consists of the Chief Minister of Delhi, the Chief Secretary, and the Chief Minister for Home Affairs.
The bill empowers the authority to make recommendations to the lieutenant governor (LG) of Delhi on the transfer and posting of officials and disciplinary matters.
The bill also empowers the LG to exercise exclusive powers over several matters, including those recommended by the National Capital Public Service Authority and the assembly, reconvening, and dissolution of the Delhi Legislative Assembly.
