CM Mehbooba Mufti today gave an ultimatum that the Indian flag will be endangered if the article 35(A) will be hampered as the residents of Kashmir Valley will pay no respect towards the flag. As it empowers the state’s legislature which gives a special status to the permanent residents as well as grant special rights and privileges to them.
Any amendments will create a feeling of disowning the national flag in the valley and we will be unable to safeguard it in J&K, the Minister mentioned.
She even states that ruling parties like Peoples Democratic Party (PDP) and National Conference put their worker's lives at risk in order to carry the flag in Kashmir.
She clearly told in a debate that she won’t hesitate to say that no one will carry the Flag and salute it in Kashmir if the article will be hampered.
CM said that by making such statements the Govt is not strengthening the state but indeed it is weakening the morale and dignity of J&K. she said that the ruling party is not targeting the separatists but they are making the forces who participated in elections fragile.
The NGO named ‘We the Citizens’ is challenging the Article 35(A) legally in the Supreme Court as the article was never presented in the Parliament nor executed by President of India.
The provision was implemented when President Rajendra Prasad used the powers to introduce the Constitution Order 1954 by Article 370 in 1954.
According to the article, any citizen from outside J&K is not allowed to acquire an immovable property or take employment within the state.
Supreme Court has prepared a three-judge bench for a larger word of mouth.
Should the article be broken or should it be kept intact? Will it bring more opportunities for the people of J&K or will it leave scars on the princely State?
