HC rejects plea of US citizen for clean chit in Beant case

The Punjab and Haryana high court has refused to set aside the conspiracy charges against a US citizen in the Beant Singh assassination case.
Harjeet Singh, who is settled with his family in Maryland (US) and wanted by CBI for his involvement in the case, had moved the high court seeking deletion of his name from the charge-sheet.He pleaded that 22 years had elapsed after the incident and he was not arrested by the cops till now.

Dismissing his plea, a single bench of Justice Surinder Gupta observed that the petitioner's name couldn't be removed from the charge-sheet mere ly on the go and that he had succeeded in avoiding arrest for a considerably long period. “He is a US citizen and always had the option to come to India and join the investigation, surrender before the court or to avail of another legal remedy available to him.The relief sought by him in the present petition is virtually seeking to quash of the FIR registered against him.From the evidence as available in the police file, I find no reason to allow the relief,“ observed Justice Gupta while dismissing the petition.

Harjeet had argued that the incident took place in 1995 and all the main accused had been convicted. As the police or CBI had not taken the assistance of Interpol or any other agency to arrest him, there was no purpose of keeping the charge-sheet filed by the CBI alive against him, he pleaded.

However, the CBI argued that the petitioner was deeply involved in the incident, in which the former Punjab chief minister and 16 others were killed. The incident also resulted in injuries to 15 people.

The petitioner was one of the main conspirators along with Balwant Singh, Jagtar Singh Hawara and Manjinder Singh, whose common object was the assassination of Beant Singh.

He has also provided financial help to accused Balwant Singh and Jagtar Singh Hawara through accused Resham Singh, settled in Germany,“ CBI had submitted. CBI files clearly outline Harjeet Singh's role in the case.“After Wadhwa Singh, Mehal Singh and Jagtar Singh Hawara agreed to assassinate Beant Singh in November 1994 at Lahore, Harjeet Singh came from the USA to India sometime in March-April 1995. He was a friend of accused Balwant Singh.

“Accused Balwant and Harjeet attributed the atrocities being committed by the Punjab Police to Beant Singh as `he had given free hand to police to eliminate any person' who raised a voice and the government was playing with the honor of people,“ the file says.

“Accused Balwant and Harjeet agreed that Beant should be killed. Hence, Balwant gave Harjeet phone number of Bhushan Sirhandi, Patiala with whom he was deployed as the gunman, as his contact number. In early June 1995, Harjeet rang up Balwant on the phone and told him that some old Sikh gentleman would contact him in connection with the task they had discussed and agreed to execute,“ it adds.
