JDA, Revenue Deptt at loggerheads over demarcation of 65,000 Kanals land

Jammu Development Authority (JDA) and Revenue Department on Monday filed status reports indicating the progress achieved in the ongoing demarcation exercise of 65,000 Kanals JDA land pursuant to the order dated September 13, 2017 passed by the Division Bench headed by Justice Alok Aradhe on the last date of hearing in a PIL highlighting the encroachment of more than 20 lakh kanals of State land by the land mafia, politicians, bureaucrats and police officers wherein the Division Bench of the State High Court is monitoring the aforesaid demarcation process in Jammu and Samba Districts.
The matter was today listed before the Division Bench comprising First Puisne Judge Justice Ramalingam Sudhakar and Justice Sanjay Kumar Gupta and the Division Bench in view of the paucity of time directed the Registry to list this PIL in the week commencing November 6, 2017 for consideration. The Division Bench also observed that the JDA and Revenue Department have filed the status reports which will be considered on the next date of hearing.
Advocate Sheikh Shakeel Ahmed with Advocates Rahul Raina, Suraj Singh and Supriya Chouhan appearing for the PIL submitted that both JDA and Revenue Department are at loggerheads and are shifting buck and in this way the demarcation will not be completed as per the time schedule fixed by the Division Bench. Advocate Ahmed further submitted that he needs adequate time to highlight the non cooperative attitude of Revenue and Police Department.
In the status report filed by JDA through Advocate Adarsh Sharma it was submitted that the JDA in compliance with the last order passed by the Division Bench took up the matter with the Divisional Commissioner Jammu and IGP Jammu vide letter No. VC/PS/2017/968-77 dated September 15, 2017 apprising the Divisional Commissioner Jammu that the schedule fixed for demarcation has not been adhered by the Revenue Department and even on September 15, 2017 the JDA officials remained waiting for the Revenue / Police Department in both the Districts of Jammu and Samba but they have not got the teams for carrying out the demarcation. The status report of JDA further stated that it was further intimated to the Divisional Commissioner Jammu and IGP Jammu that matter of demarcation is over delayed due to non compliance of the High Court order by the Revenue and Police Department. The report further stated that the JDA officers were not provided police protection by deploying PSOs for which request had been made to the IGP Jammu. The JDA’s status report further stated that it had requested for two reserve companies of Police for accomplishing the demarcation task but this request was not considered by the Police Department. It was further stated in the status report that the progress of demarcation is far behind the schedule due to non availability of Revenue staff on the scheduled date and time for one reason or the other and in this regard the Tehsildars of JDA from time to time intimated the Deputy Commissioners Jammu as well as Samba. It is further divulged in the status report that besides demarcating 4,148 kanals and 5 marlas of JDA land, the fencing work of 1,368 kanals 3 marlas of JDA land has also been done in addition to 1,566 kanals 12 marlas of JDA land already stated in the status report filed on September 13, 2017. The Revenue papers of 2,714 kanals 5 marlas of demarcated JDA land have been received from the Revenue Department in addition to Revenue papers of 1,087 kanals 11 marlas of JDA land already stated in the earlier status report.
Deputy AG Ehsan Mirza also filed status report on behalf of Deputy Commissioner Jammu wherein it is stated that due to pre-occupation of the Revenue field staff a tentative schedule for the demarcation of JDA land has been formulated from October 15, 2017 to December 3, 2017 and as and when demarcation of JDA land will be conducted by the Committees constituted for demarcation of JDA land same will be submitted for the perusal and consideration of the court. Senior AAG Seema Khajooria Shekhar appeared for General Administration Department and Deputy AG Raman Sharma appeared for State Vigilance Organization.
