‘My Government’ expression can be made by PM, CM only: MLC Paray

Advocate Mohammad Muzaffar Paray, Member Legislative Council (MLC) emphasised that the expression ‘My Government’ can be used only by Prime Minister of the Country or the Chief Minister of the State.
While addressing a press conference here on Tuesday, Paray said that as per law laid down by Supreme Court of India in a case titled Shamsher Singh versus State of Punjab and another bearing citation (1974)2 Supreme Court Cases 831, President and Governor are formal or constitutional heads of the executive, the real executive powers are vested in a Council of Ministers with Prime Minister as its head in case of Union Government and Council of Ministers with Chief Minister as its head in case of State. And as such it falls within the domain of Prime Minister or Chief Minister to use the expression ‘My Government’.
The MLC Mohammad Muzaffar Paray expressed his reservation with regard to usage of expression ‘My Government’ by Governor. He maintained that the parliamentary conventions cannot override the constitutional imperatives and observations of highest judicial tribunal, viz Supreme Court.
