During the hearing of the Nirbhaya case, the Supreme Court on Friday has clarified that the trial court may issue new death warrants for Nirbhaya's convicts. But when the petition for the death warrant is heard in Patiala House Court on 17 February, there may be a problem in front of the court which may delay the issuance of the death warrant.

Significantly, on Friday, a three-judge bench of the Supreme Court asked the trial court to hear on merit basis and clarified that the pending petition of the Central and Delhi government seeking to hang the culprits separately for the trial court There will be no obstruction in the way of issuing death warrants. The bench posted the next date of hearing on 20 February. Now it will be necessary to know what screws can get stuck even after the permission of the Supreme Court.

It may be a problem
that out of the four convicts Mukesh, Akshay, Vinay and Pawan, all the legal options of the three convicts have been exhausted. It is only Pawan who has to submit curative petition and mercy petition. However, during the hearing on Thursday, the counsel for the convict AP Singh told the court that he had dropped Pawan's case. The court then provided Pawan with a new lawyer. This lawyer has been given time till Monday for the case study. In such a situation, Pawan's new lawyer Ravi Qazi should say in the court that he needs some time for the case study to be given to the court. In such a situation, hanging of the four convicts can be postponed for some more time.

However, as the court is taking a tough stand in this case, it seems less likely. But the court has said earlier that Article 21 of the Constitution gives the option to defend the 21 convicts till the last breath. In such a situation, the court is giving the culprits every chance that they can defend themselves.

on Friday, a bench of Justice R Bhanumathi, Justice Ashok Bhushan and Justice AS Bopanna postponed the hearing on the plea of the Center till 17 February. The bench said that when the trial court will hear the matter on 17, it is better that the Supreme Court wait for its decision. The case has been listed for hearing in the Supreme Court on 20 February.

"No plea of the convicts is pending before the apex court and mercy petition of the three accused has also been rejected by the President," the bench said. At the same time, the fourth convict Pawan has not yet given any plea. In such a case, the lower court can issue a new date of execution.
