While issuing this notice, the court said that the Delhi High Court's one-week time expires on February 11, in which case 11 faravaro will be heard. The High Court had cited Delhi prison manual stating that all the culprits would be hanged together and not separately. According to the rules, there is a provision to hang all the culprits at the same time.

The Central Government is arguing that Nirbhaya's execution of all the four convicts has used all his legal and constitutional measures.

Significantly, on December 16, 2012, Nirbhaya, Ram Singh (had committed suicide in Tihar Jail), a Nabagig (it has completed his three-year sentence), Mukesh Singh, Akshay Singh, Vinay in Delhi's Vasant Vihar area. Kumar Sharma and Pawan Kumar Gupta pleaded guilty. All the six criminals not only gang-raped Nirbhaya but also tortured her so much that she died in hospital during treatment. After this, the Delhi High Court and the Supreme Court have sentenced the four convicts (Pawan, Vinay, Akshay and Mukesh) to be hanged after the trial court.
