Law out of order in UP: Turbaned Sikh man challaned Rs 500 for not wearing helmet while riding bike

Moradabad, 19-Sep-2020

A little over a year after a man in UPs Aligarh was issued an e-challan for not wearing a helmet while driving a car, a similar incident has come to light from Moradabad. A turbaned Sikh man was issued a photo challan allegedly not donning a helmet while riding a motorcycle. As per Section 129 of the Central Motor Vehicles Act, Sikhs, both men and women, wearing turbans are exempted from wearing protected headgear.
Sikh man receives photo challan for not wearing helmet: Such a Singh, a Kothiwal Nagar resident, said the traffic police, a few days back, sent a photo challan issued against the registration number of his motorcycle to his address for a traffic violation of not wearing a helmet and directed him to pay a penalty of Rs 500. The other shocking part of the challan is that date of its generation, as mentioned in the document, is "August 21, 2010". The traffic police has sent it 10 years after the alleged violation took place. The photo challan clearly shows that I was wearing a turban when the challan was issued. I have yet not approached the traffic police about the matter, but I will soon be submitting an application against the challan that was issued illegally, a report by The Times of India quoted Singh as saying.

'Wrong challan' issued by traffic cops, says SP

Meanwhile, traffic police officials said that the Singh was challened by mistake. Moradabad SP (traffic) Ashok Kumar Singh told that Singh was mistakenly issued a photo challan. It was immediately revoked when he learned about it, the SP said, adding that he would conduct an inquiry so as to find why a wrong challan was issued by the traffic cops.
