Litigation Challenges JKPSC’s Reconstitution Before HC

Fresh litigation challenging the government order for the reconstitution of the Jammu Kashmir Public Service Commission (JKPSC) was moved before the High Court on Thursday.

The petition filed by General Secretary, Abdul Rashid Tantray of Moulana Azad Educational Trust through his counsel Manzoor Ahmad Ganie states that the GAD has interpreted section 93 of the JK Reorganisation Act 2019 “as if the Chairman and members of the commission were to function only till the appointed day”.

“However, the order is issued by the incompetent authority, GAD, which is preparing to initiate a fresh exercise for reconstitution of the PSC,” it says.

It states that the said government order violates Article 14 of the constitution “as it fails to meet the test of reasonableness and non-arbitrariness”.
